Recently, the police of the Public Security Management Brigade of the Public Security Bureau of Yijinhuoluo Banner, Inner Mongolia, discovered during a routine inspection that a foreign man was suspected of illegal employment in an education consulting company in the jurisdiction.

近日,内蒙古伊金霍洛旗公安局治安管理大队民警在例行检查时发现,辖区某教育咨询公司有一名外籍男子涉嫌非法就业。

After investigation, the education consulting company hired a foreign man as a foreign teacher, but the police found that the foreign man had not obtained the work permit and work residence permit for employment in my country, which was illegal employment. The main person in charge of the education consulting company, Wang Mou, hired the foreign man to engage in teaching activities without checking the relevant documents, which constituted an illegal employment of foreigners.

经查,该教育咨询公司聘用一外籍男子担任外教,但民警却发现该外籍男子未取得在我国就业的就业许可证及就业类居留证件,属于非法就业。该教育咨询公司主要负责人王某在未核查相关证件的情况下便聘用该外籍男子从事教学活动,已构成非法聘用外国人行为。

According to the relevant provisions of the "Exit and Entry Administration Law of the People's Republic of China", the foreign man involved in the case was fined 5,000 yuan according to law, and the person in charge of the education consulting company involved in the case, Wang Mou, was fined 10,000 yuan according to law.

根据《中华人民共和国出境入境管理法》相关规定,涉案外籍男子依法被处以罚款5000元的处罚,涉案教育咨询公司负责人王某依法被处以罚款10000元的处罚。

Article 41 Foreigners working in China shall obtain work permits and work-type residence permits in accordance with regulations. No unit or individual may employ foreigners who have not obtained work permits and work-type residence permits. Measures for the administration of foreigners working in China shall be formulated by the State Council.

第四十一条  外国人在中国境内工作,应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。外国人在中国境内工作管理办法由国务院规定。

Article 43 Foreigners who commit any of the following acts are considered illegal employment: (1) Working in China without obtaining a work permit and a work-type residence permit in accordance with regulations; (2) Working in China beyond the scope of the work permit; (3) Foreign students who violate the work-study management regulations and work in China beyond the prescribed job scope or time limit.

第四十三条  外国人有下列行为之一的,属于非法就业:(一)未按照规定取得工作许可和工作类居留证件在中国境内工作的;(二)超出工作许可限定范围在中国境内工作的;(三)外国留学生违反勤工助学管理规定,超出规定的岗位范围或者时限在中国境内工作的。

Article 80 A foreigner who engages in illegal employment shall be fined not less than 5,000 yuan but not more than 20,000 yuan; if the circumstances are serious, he shall be detained for not less than 5 days but not more than 15 days, and shall be fined not less than 5,000 yuan but not more than 20,000 yuan. Those who introduce foreigners for illegal employment shall be fined 5,000 yuan for each illegally introduced person, but the total amount shall not exceed 50,000 yuan; the unit shall be fined 5,000 yuan for each illegally introduced person, with a total amount not exceeding 100,000 yuan; there are illegal gains. Those who illegally employ foreigners shall be fined 10,000 yuan for each illegally employed person, with a total amount not exceeding 100,000 yuan; if there are illegal gains, the illegal gains shall be confiscated.

第八十条 外国人非法就业的,处五千元以上二万元以下罚款;情节严重的,处五日以上十五日以下拘留,并处五千元以上二万元以下罚款。介绍外国人非法就业的,对个人处每非法介绍一人五千元,总额不超过五万元的罚款;对单位处每非法介绍一人五千元,总额不超过十万元的罚款;有违法所得的,没收违法所得。非法聘用外国人的,处每非法聘用一人一万元,总额不超过十万元的罚款;有违法所得的,没收违法所得。
